These terms apply to purchases of goods from bonitablomster.no. The sale is governed by Norwegian consumer law, including the Consumer Purchases Act (forbrukerkjøpsloven), the Right of Withdrawal Act (angrerettloven), the Marketing Control Act (markedsføringsloven) and the E-commerce Act (ehandelsloven). Nothing in these terms limits the rights you have under mandatory law; the terms set out the main rights and obligations of the parties. This English text is provided for convenience; Norwegian law applies to the agreement.

1. The agreement

The agreement consists of these terms, the information given in the order solution at checkout, and any separately agreed terms. Where these conflict, what is specifically agreed between the parties prevails, provided it does not conflict with mandatory law.

The agreement is supplemented by the relevant statutory provisions governing the sale of goods between businesses and consumers.

2. The parties

referred to below as "we", "us" or "the seller".

Buyer is the consumer who places the order, referred to below as "you" or "the buyer".

3. Price

The price stated for a product is the total price you pay, including VAT and all other charges. Any additional costs not disclosed before the purchase will not be charged to you. Delivery fees, where they apply, are shown at checkout before you confirm the order.

4. Conclusion of the agreement

The agreement is binding on both parties once you have submitted your order through the checkout.

The agreement is nevertheless not binding if there has been a typographical or input error in the offer in the order solution, or in your order, and the other party realised or should have realised that such an error existed.

5. Payment

You can pay using payment card (Visa / Mastercard, processed by Stripe), Vipps, PayPal, or Klarna. The methods available are shown at checkout.

For card payments, we may reserve the purchase amount on the card when you order. The card is charged when the order is dispatched for delivery, or on the delivery date.

Buyers under 18 cannot use invoice or other deferred / credit-based payment methods (for example Klarna invoice or instalments).

6. Delivery

Flowers are delivered to the address you specify. It is therefore important that you are sure the recipient is at that address and that the address is correct. We cannot take responsibility for orders that fail to be delivered because of missing or incorrect information you have provided.

The recipient is, in most cases, not called before delivery. The phone number is normally used only when there is difficulty finding the address or entrance, or if there is some other problem with the delivery. We encourage you to provide a mobile number we can reach you on for every order, so we can give you delivery updates or ask questions about your order.

If the recipient is not at home, we reserve the right to leave the flowers at the door or with a neighbour. In freezing temperatures we will first try to deliver to a neighbour; if the neighbour cannot receive them, the flowers are either left at the recipient's door with adequate packaging or returned to the shop.

Flowers are returned to the shop when the recipient is not at home, the address is wrong, the phone number is wrong, or for other reasons that mean we cannot contact the recipient. Our customer service will contact you the day after the attempted delivery, or as soon as possible, with the message that the order has been returned. If the cause is incorrect information provided by you, or that the recipient did not answer our calls, the flowers must either be collected from our shop by the recipient, or you must pay for a second delivery.

Delivery times. Delivery to private recipients is mainly in the afternoon and evening — most orders are delivered after 15:00 and until approximately 21:00. We cannot guarantee a specific delivery time. Delivery to businesses takes place within normal office hours, defined as 08:00 to 17:00. We deliver to the reception unless you have provided the exact floor and door/office number; if no further details are given, we are not responsible for onward delivery within the building after the flowers have been handed to reception. It must be clear from the order that the address is an office / business.

Hospitals, hotels and similar. It is your responsibility to check that the patient or guest is present when the flowers are to be delivered, and whether they are allowed to receive flowers — some hospitals are flower-free, and intensive care, cardiac and pulmonary wards often restrict flowers. The department / room must be specified in the order. If we deliver to a patient or guest who cannot receive the flowers, we cannot refund the amount. The flowers can be sent to another address on request, which will incur a new delivery charge at your expense.

7. Risk for the goods

Risk for the goods passes to the buyer, or the recipient acting on the buyer's behalf, once the goods have been delivered in accordance with section 6.

8. Right of withdrawal (angrerett)

As a consumer you generally have a 14-day right of withdrawal under the Right of Withdrawal Act, running from the day after you receive the goods. To use it, you must notify us before the deadline; for evidence reasons the notice should be in writing (email to orders@bonitablomster.no, or the standardised withdrawal form). You then return the goods without undue delay and at the latest 14 days after notifying us.

Exemptions that apply to most of our products. The right of withdrawal does not apply to:

  • Perishable goods — cut flowers and plants. They deteriorate quickly and are exempt under angrerettloven § 22.
  • Custom-made or personalised goods — bouquets and arrangements made to your specification, and similar bespoke or large made-to-order items.

For these products there is no right of withdrawal once the order is placed. Standard, non-perishable items held in stock (for example a vase or a boxed gift) are not exempt and keep the ordinary 14-day right of withdrawal.

Where the right of withdrawal does apply and you use it, we refund the amount you paid without undue delay and at the latest 14 days after we are notified, using the original payment method or by bank transfer. We may withhold the refund until we have received the goods back, or you have documented that they have been returned.

9. Substituted or unavailable products

If a selected product is not available or is sold out, we reserve the right to replace it with a similar item of equal or greater value. If the replacement would deviate significantly from the original order, we will contact you first.

10. Defects and complaints (reklamasjon)

If there is a defect in the goods, you must notify us within a reasonable time after you discovered or should have discovered it. The complaint should be made in writing to orders@bonitablomster.no.

Because flowers and plants are perishable, any complaint about their condition must be made promptly — ideally within 48 hours of delivery — and accompanied by a photo, so we can assess the issue and put it right. Depending on the case, we will repair, replace, offer a price reduction, or refund in accordance with the Consumer Purchases Act. Your statutory rights are not limited by this section.

11. Returns, cancellation and refunds

We do not give cash refunds for online orders. Where a refund is due, it is issued to the original payment method or by bank transfer.

We accept returns of non-perishable products as long as they are in good condition and the purchase receipt can be presented. Returns outside your statutory rights are handled by exchange or store credit with no expiry date. Refunds required under your statutory withdrawal or complaint rights (sections 8 and 10) are paid to the original payment method or by bank transfer.

If you cancel an order, we can issue a full refund for in-stock items that have not yet been prepared. Individual, customised orders, items not held in stock, or larger volumes that need more planning are usually paid with a non-refundable deposit, with the balance charged before delivery. If such an order is cancelled, the balance is not charged but the deposit is not refunded. The deposit terms can be agreed individually.

12. Personal data

The data controller for personal data we collect is BONITA SERVICES AS. We collect and store only the personal data necessary to fulfil our obligations to you under the agreement — for example buyer and recipient contact details and delivery information. We process this data on the basis of the agreement with you and applicable law.

Your data is shared with others only where necessary to carry out the agreement (for example our payment providers and delivery partners) or where required by law. We do not use your data for marketing purposes unless you have consented, and you can withdraw that consent at any time. You may request access to, correction of, or deletion / anonymisation of your data by contacting orders@bonitablomster.no.

If you do not provide a phone number we can reach you on, we may be unable to give delivery updates or complete the delivery.

13. Guarantee

Any guarantee we give is in addition to your rights under mandatory law and does not limit your right to complain or claim for delay or defects under sections 10 and 11.

14. Dispute resolution

Complaints should be directed to us within a reasonable time, and the parties should try to resolve any dispute amicably. If this is not successful, you can contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation: phone 23 400 600, www.forbrukertilsynet.no.

If you are a consumer resident in another EU/EEA country, you can also submit a complaint through the European Commission's online dispute resolution portal: http://ec.europa.eu/odr.

15. Age

Customers ordering online and paying by card, PayPal or other online payment methods must be at least 18 years old.
